1. Acceptance of Terms

By accessing or using KibaSwap (“the App”), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Non-Custodial Nature

KibaSwap is a non-custodial decentralized application. We do not hold, control, or have access to your funds, private keys, or seed phrases. You retain full custody and responsibility for your digital assets at all times.

All transactions are executed directly on the Solana blockchain via your connected wallet. KibaSwap cannot reverse, cancel, or refund any transaction once it has been submitted to the network.

3. Platform Fees

KibaSwap charges a platform fee of up to 0.5% per swap. This fee is collected via the Jupiter Aggregator referral program and sent to a publicly visible on-chain fee wallet. The fee is deducted from the output token amount before it reaches your wallet.

Fee rates are disclosed in the swap interface before you confirm any transaction. By proceeding with a swap, you acknowledge and accept the displayed fee.

4. No Financial Advice

KibaSwap is a tool for executing token swaps. Nothing in the App constitutes financial, investment, legal, or tax advice. All trading decisions are made at your own risk. You should consult with qualified professionals before making any financial decisions.

5. Risks

  • Token prices are volatile and may change between quote and execution
  • Slippage may result in receiving less than the quoted amount
  • Blockchain congestion may delay or prevent transaction confirmation
  • Smart contract risk exists with all DeFi protocols integrated via Jupiter
  • No guarantee of liquidity for any token pair

By using KibaSwap, you acknowledge and accept these risks.

6. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use KibaSwap. The App is not available to residents of countries or regions subject to sanctions by the United States, United Nations, European Union, or other applicable governing bodies, including but not limited to OFAC-sanctioned jurisdictions.

7. Prohibited Use

You agree not to use KibaSwap for:

  • Money laundering, terrorist financing, or sanctions evasion
  • Fraud, market manipulation, or illegal activity of any kind
  • Transactions involving stolen or illicitly obtained assets
  • Any activity that violates applicable laws or regulations

8. Intellectual Property

KibaSwap UI, branding, and original code are the property of KibaSwap. The underlying code is open-source under the MIT License. Third-party trademarks (including Solana, Jupiter, Phantom, and Solflare) are the property of their respective owners. KibaSwap is not affiliated with or endorsed by these third parties.

9. Disclaimer of Warranties

KibaSwap is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, KibaSwap and its contributors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the App, including but not limited to loss of funds, loss of data, or failed transactions.

11. Third-Party Services

KibaSwap integrates with third-party services including Jupiter Aggregator (swap routing), Helius (RPC infrastructure), and wallet providers. These services have their own terms and conditions. We are not responsible for the availability, performance, or actions of these third-party services.

12. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms. The last updated date at the top of this page indicates when changes were last made.

13. Termination

We reserve the right to terminate or restrict your access to the App at our sole discretion, without prior notice, for conduct that violates these Terms or applicable law.

14. Governing Law

These Terms are governed by the laws applicable to decentralized software, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration where permitted by applicable law.
